1. Introduction
These Terms of Service (the “Terms”) govern the use of the BTW Messaging Service (the “Service”), an internal business communication platform operated by Bina Taruna Wiratama (“we”, “us”, or “our”). By using the Service, you agree to be bound by these Terms.
2. Service Description
The BTW Messaging Service is a WhatsApp Business API-based messaging platform designed for internal business communication within Bina Taruna Wiratama. The Service enables authorized personnel to send and receive messages for operational and administrative purposes.
3. Eligibility and Access
The Service is intended exclusively for:
• Employees, staff, and authorized representatives of Bina Taruna Wiratama.
• External parties who communicate with Bina Taruna Wiratama through our official WhatsApp Business channels.
Access to the Service’s administrative functions is restricted to authorized personnel only.
4. Acceptable Use
Users of the Service agree to:
• Use the Service only for legitimate business communication purposes.
• Comply with all applicable Indonesian laws and regulations.
• Comply with WhatsApp’s Terms of Service and Business Messaging Policy.
• Not use the Service to send spam, unsolicited messages, or promotional content to individuals who have not opted in.
• Not use the Service to transmit illegal, harmful, threatening, abusive, or otherwise objectionable content.
• Not attempt to reverse engineer, modify, or tamper with the Service’s infrastructure.
5. Message Consent and Opt-Out
We respect the communication preferences of all recipients. Recipients of messages through the Service may opt out of receiving further communications at any time by replying “STOP” or by contacting us directly. We will honor all opt-out requests promptly.
6. Intellectual Property
All content, software, and technology associated with the Service are the property of Bina Taruna Wiratama and its technology partners. Users may not copy, modify, distribute, or create derivative works based on the Service without prior written consent.
7. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, availability, or fitness for a particular purpose of the Service. We do not guarantee uninterrupted or error-free operation.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Bina Taruna Wiratama shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Service, including but not limited to loss of data, loss of revenue, or business interruption.
9. Third-Party Platform
The Service operates on Meta’s WhatsApp Business Platform. Users acknowledge that the use of WhatsApp is subject to Meta’s own Terms of Service and policies. Bina Taruna Wiratama is not responsible for any changes, disruptions, or limitations imposed by Meta on the WhatsApp Business Platform.
10. Termination
We reserve the right to suspend or terminate access to the Service at any time, with or without notice, for any reason, including but not limited to violation of these Terms or discontinuation of the Service.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Indonesia.
12. Changes to These Terms
We may modify these Terms from time to time. Updated Terms will be communicated through appropriate channels. Continued use of the Service after any modifications constitutes acceptance of the revised Terms.
